Rationale

The purpose of this policy is to outline the Board’s position in relation to the finding of a faulty generic design during the course of its investigations into a matter.

Policy

During the process of investigating a complaint into a Registered Professional Engineer of Queensland (RPEQ) or an unregistered professional engineer providing engineering services, the Board may become aware that a generic engineering design of a mass-produced item is faulty in its engineering design.

In recognition of the need for protection of the public, the Board may, as part of actions taken on the matter, contact relevant authorities such as the Australian Competition and Consumer Commission (ACCC) to inform them of the issue.

The Board will also inform the engineer concerned and advise the engineer of their duty of care to make every reasonable effort to contact affected clients directly to advise them of the fault in design.
